My Apology to Mary Tipton

I'm sorry Mary.

My multitudinous words accomplished nothing.

Detective Thomas Clipper shit on your life with his mishandling of a computer video that likely would have proven Marisa Govea Hernandez made no effort to look for you after plowing through you with her vehicle.  She continued talking on the phone for nearly four minutes after killing you.

Still.  She struck you with her vehicle and did not stop to render aid. Was she impaired?  We will never know since BPD Officer Nino allowed her son, Cameron County Sheriff's Deputy Marin Hernandez, to explain what he thought happened on FM 803 that night, only taking her ID through the doorway.

Her boys, Marin and Mario, well-rehearsed and in uniform, explained how she "closed her eyes," then searched for your body. They likely lied to protect their mother.  

Judge Banales was not your friend.  He's been involved in two vehicle/pedestrian accidents and got off scot-free.  Giving you justice would have been ruling against himself, but he lacked the courage or honesty to recuse himself.

I'm sorry you had such an ineffictive prosecutorial team; 29 year old Nathaniel Navey and the inept Oscar Guzman.  They did not command the courtroom or get justice for you.  Neither knew how to use a microphone or give closing arguments.  

I'm so sorry.

  1. I am saddened to say the least!! That was the prosecutors office way of securing this verdict for the good friend to the DA and several judges including "Judge Ugly Ass Mustache" Ernesto Gamez is well known for paying off judges and the DA for favorable rulings. They used one of the worst ADA to prosecute this case. That was part of their master plan to let a murdering ass bitch of Scott free. Justice working the ol' Mexico Way!!

  2. There is still another possibility. That everything said was what actually happened. I don't know the victim or the accused, but that is why we have Due Process. She was tried and found not guilty. Seems you were involved personally in this case. Were you paid by the husband? I follow your blog and seems very peculiar you started getting more involved after the husband was ordered to stay off social media. Were you his "voice"? I honestly believe as a blogger your duty is to stay objective and unbiased which obviously you weren't.

  5. This goes to show you that re electing the same idiots to office that the people of Brownsville do over and over needs to change and become educated. The RGV does not get involved unless to protect another and the police and sheriff's department is well known for cover ups. They are under investigation. But again those head positions are elected. Unfortunately non of this will bring back Mary or give her true justice. The first thing to do is remember her on election day. Remember all the unjust and remind all. Second help others especially mother and children. Those are the best ways to give back to Mary. I pray her husband can move on and move out of the RGV for a while he needs to break from that place. Prayers for all.

  7. Mr. Jim, can you please write a separate entry in your blog and post this link to the petition by Ralph Tipton so the public can sign and bring awareness to our corrupt county. Please. Right now Mary's case is on everyone's mind, this is the time to post the petition again, get more signatures, cause the state and federal governments to look into it. Idk how many signatures are needed, but I think the people want to do "something" to help and giving them the petition to sign and share is a good "something". Please and thank you.   11. I think the people that are commenting on how justice was not served and what not really need to get their facts straight before passing judgement. If she was a murderer, she wouldn't call for help. Timeline is insignificant just like failure to rendure aid. Shit if I hit something in a very dark secluded road, I will definitely not stop. We have alot of wildlife here and I'll be dammed to get off. This would be a cold case by now if she hasn't called stating she hit something. It's that simple. I'm not taking sides but she has her day in court and obvious she was found not guilty. Both families have been affected tremendously already. May Mrs. Tipton RIP and may Mrs, Govea find closure and move forward. Maybe this will be an eye opener for the county to invest in having lighting on that long road and also a shoulder lane. God bless

    1. You do not know the facts. Had she not called the case would have been easier. The video ID the car. So your claim of a cold case is totally without merit. Now I agree the area was a very dangerous area to be walkining in. I agree the county or state whom ever has jurisdiction needs to put in more lighting. I agree both families have suffered. But justice was not done. The jury got it right based on their instruction from the judge. But the case law is clear, because the son was aloud testify they searched, their was no basis in law for the spoliation instruction. I based on the spoliation instruction, not matter what I think of Marisa Hernandez I would have found her not guilty. The spoliation instruction made it impossible to find her guilty beyond a reasonable doubt. This case needs to be the basis of the battle for due process rights for the victim. Texas law as written allows the judge to corrupt the case for the accused with no remedy for the State of victim. The mandamus option would be new, but on the chance it will bring due process rights to the victim the mandamus must be taken for a mistrial because of the bad spoliation instruction.

    2. I hit a rabbit one time on the road. I remember like yesterday even though it was years ago. I could see its long ears, its strong, wild hind legs. I thought "move away!" but it actually jumped closer to the road, and there was an oncoming car's headlights in the other lane, approaching. I would have swerved to avoid the rabbit except it would have meant I'd go into the oncoming car.

      Have never forgotten the sound/crunch/thump of the rabbit under my tires. It's a horrible memory I can't forget and I am sorry to the little critter as that is the only animal I have ever run over. Still see, in my mind's movie camera, its little hind legs and long ears being pulled under my tires - thump -

      To say I could have run over a human being and somehow not known the difference is insane. I can still see that rabbit's long ears and its long hind legs, it's furry grey/white body in the street in the headlights, in slow motion. This was over 5 years ago. I have a dead rabbit etched in my brain. I know without doubt this Govea killer saw Mary Tipton's face and body. There are a few seconds where you want to turn the steering wheel and you don't. Where time slows down and you see everything as if frame-by-frame. second by second. No doubt in my mind Hernandez is a murderess and a liar to boot. Burn in hell liar.

There so much space to either side to have avoided this...I go through this road on a daily basis..Should of got off the street...or stayed on the grass..Love her tortillas and will continue to give her business..lol

  18. Thank GOD I don't live in the valley! Some of you commenting are beyond help and live in such a corrupt area. "You scratch my back, I'll scratch yours type of mentality." Justice was not served in this case and was very much tainted by those that are to protect and serve as well as those in the higher legal system. It's such a shame to read things of this nature. Perhaps they had a great plea bargain in place.....oh yes! Give me a not guilty verdict and I'll give you all a years worth of my tortillas! LMAO RGV still living in the stone ages!   19. Wow a woman is Dead and I am sorry justice was not served, she might be not guilty but Mrs Govea killed her and all she did was cry about how she and her sons were wronged in this whole process. She showed no remorse to Mary Tipton or her family. She is guilty of that!
