Judge Banales Reaffirms Gag Order in Marisa Hernandez Hit-and-Run Case

Judge J. Manuel Banales of Corpus Christi did something Friday morning few political figures do.  He apologized.

"I apologize for the delay," began Judge Banalas, appearing at 10:20 AM for a hearing scheduled for 9:00 AM in the 445th court.

"I was held up for 1-1/2 hours on I-69 by an accident involving an 18 wheeler."

The judge initiated the hearing by calling Ralph Tipton, the husband of Mary Tipton, who was struck down by a car driven by Marisa Hernandez on FM 803 on 2/28/15.

"Is the surviving spouse of the victim in the courtroom?" asked Banales.

Ralph Tipton came forward, fielding questions from Defense Attorney Ernesto Gamez.  The exchange was mostly inaudible from my front row seat, but I picked up a few sentences.

"Are you aware of an order to not talk about this case?" asked Gamez.

"I learned about it two minutes ago," responded Tipton.

Judge Banales weighed in:  "The law requires this case be tried fairly.  Anyone who does something to impinge this case, even a victim of this incident faces consequences.

I'm reaffirming a gag order in this case including any statement on the internet, twitter or social media.  If you violate that order, you can be found to be in contempt of this court, subject to incarceration up to 180 days and a fine of $500 for EACH violation.  Ten violations could result in 10 times 180 days or 1,800 days, several years, in jail."

Then came Banales' most ominous warning to Tipton:  "If this case goes to court and the defendant is found guilty, your conduct could result in a mistrial.  We'd have to do this thing all over again."

While Ralph's anger is totally understandable, he's been his own and the case's worst enemy with his all caps rants on Facebook, railing at every local official for corruption, frequently overstepping the understanding of presumed innocence until proven guilty.

But, consider these known facts:  His wife was struck by a vehicle whose driver did not stop and render aid.  The Brownsville Police Department did not even interview the driver of the vehicle, instead taking a statement from her son, who happens to be a Cameron County Sheriff's deputy. 
A warehouse security videotape, in the control of the Brownsville Police Department was reduced in length from three days to 30 seconds and subsequently viewed as "insufficient" by Judge De Coss.  The Cameron County Sheriff's Department investigation can best be described as reluctant, with much of the evidence provided by the victim's husband.  How could Ralph not possibly be angry?

I simply could not stay for the entire hearing.  Jack was not allowed in the courtroom and two hours of monitoring taxed the energy of his grandma.

When a BPD officer told us we could not bring a child into the courtroom, Jack told his grandma:  "That's so rude to kick a kid out who just wants to learn things."

  2. This kid is light years ahead in both depth and experience of the average Brownsville curriculum at BISD. Just curious, what does Jack think about the gag order? If his family member were killed, the only statement the cops took was of the son of the driver who happened to also be a cop, does he consider that fair? Would he think it's fair no one else its allowed to talk about it on social media or anywhere else? Freedom of the press excluded here or what?

  3. Jack is a little kid, not yet 7, very loving and fiercely loyal to his grandma. He knows the ABC's and basic math, uses big words we're not sure he really knows. He has a chat group of 150 on Minecraft and is learning to put his clothes in the dirty clothes hamper, order at Burger King and pump gas. We hope we can live long enough to see him almost grown up.

  5. From 3 days to 30 seconds, which by the way shows where she hit Ms Tipton and kept on driving, and DeCoss rules insufficient evidence? That's not right.

  6. The gag order does not apply to the BV. Until the trial I will post all videos and depositions in the civil case wherein her own son admits she was driving, including the video of a car hitting mary Tipton. This will be daily until the trial. The people will not be silenced

  7. It is amazing how the judicial system turns a blind eye and how it can be manipulated. If they want to Target and ruin you, the system is not their to protect you and if you commit fraud like Joey de la Garza did or run after killing some one on the road like Mary Tipton, the system does all it can to favor the person who killed her instead of doing something to all involved who have done all they can to minimize the criminal act and Mary's life.   8. Must be the Hernandez family is running scared. Imagine how many law enforcement, judges, lawyers and not to mentioned Luis Saenz, involvement in misguiding this case. Ernesto Gamez must of known when to post the case so that Banales could help him out of the mess he created. Why not have change of venue as the Trevino case? Can't wait for the surprise, maybe former alleged corrupt lawyer Eddie Lucio will surprise us again. What judge ruled and allowed deferred adjudication for this criminal, in the first place? This is nothing but third world ruling. We must educated some so called experts and inform them that Brownsville, Texas is not a dictatorship city such as Mexico. This is my opinion

  9. Pendejo, do you know what due process means or is? You think you are smart, but the biggest pendejo is you. If due process has been followed, Gives would had been taken into custody, charged, bonded, and a trial held. In this instance Pendejo her son gave a statement on the hit and run that resulted in Mary Tipton's unnecessary death. Govea blood alcohol was not obtained, nor a first hand statement given immediately, nor her vehicle impounded before it was tampered with by Govea or her accomplices and her son was not arrested for interfering in a police investigation and/or being an accomplice to a crime. And, more that Pendejos like You try to brush officina​ as acceptable in what I believe was the same as cold blooded murder. Had Govea stopped and rendered aide, perhaps Mary would have survived. It is unconscionable to hit a person and leave them to suffer and die. Was the body moved in an effort to avoid prosecution. Would the video been secured immediately had Govea stopped to render aide? Pendejos like Chris always shoot their mouth off just to attack me instead of looking at the facts.

  12. Regardless of how you pendejos feel about Pat. The truth is how would you feel if Mary Tipton was your wife, mother, sister, daughter hit by someone who failed to stop and render aid. Then to add insult to injury the video evidence that was in custody was reduced to just seconds. You do not have to be a brain surgeon to figure out that this does NOT look good. Come on open your fucking eyes this is the ol' buddy system working here to cover up a bunch of mistakes from the beginning of this criminal act. This JUDGE is NOT worth a DAMN! HE is a POS dirty ass judge. He is very friendly with some of Cameron Counties dirties politicians like Gilbert Hinojosa, Luis Saenz, Ernesto Gamez and a bunch of other dirty players. Justice needs to be served but this is Cameron County where things are run the ol' Mexico Way
