Quintanilla Tries to Block Foreclosure on Dallas Home

by Jim Barton on Tuesday, November 22, 2011 at 1:04pm

It's inappropriate to rejoice on someone else's misery, but the ongoing foreclosure on Carlos Quintanilla's 6000+SF home in Dallas certainly factors in to his desperation level.  I'm just hopeful that enough information about what the convicted racketeer is attempting to do with BISD will get out before he fully accomplishes his mission.
On a related note, Mary S. Rey informs me that she is proceeding with part 2 of her deposition, which she says will deal more closely with the relationship between Carlos Quintanilla and Catalina Presas-Garcia.  I've alreadly listened to many of the recordings and read the texts and feel it will be powerful.

ps:  I will be personally reviewing the above document, taking notes.  So I may add more to the story later.   I just wanted to get this much of it out.  Time is of the essence.

  1. Nice fine Jim. In one of the exhibits Mr. Quintanilla signed a document stating he did not pay the mortgage from July 2007 though April 2011. Where did he get the $1,000 he claims he donated to the PAC? Someone needs to get the PAC records to see if he really donated money. Did you see that check from Ohio? It looks like it may have come from one of his partners in Fly Frontera.

  3. We will just have to see if Quintanilla prevails won't we.

  4. The company that purchased the loan from Option One has already been enjoin and sent to mediation. Quintanilla prevailed.

Option One then sells the mortgage in a questionable manner and Quintanilla sues these bastards and is rightfully defending his property and assets. It states he has made over $25,000 in mortgage payments plus pay for his insurance. That is more than what Jim Barton home is worth.

We will see if the judge reaffirms Quintanilla's arguments.

Option One was sued by thousands of individuals for fraudulen loans as part of Country Wide. These guys are no saints. Go Quintanilla kick their asses.

Let's Put It Out In The Public and Let's Set The Record Straight.

How do you get from $12,000 to $221,000 in penalties and fees?

How do you purchase a note without ever giving a notice to the person who owns the home?

How do you justify filing foreclosure every month even before payment is due?

What are the political motives of this questionable purchase of Quintanilla's mortgage by a gas exploration company that has no residential investments, Quintanilla's property is the only residential property that this company owns.

Why has the lender refused to provide documents on how they purchased the home from American Home Mortgage and what they paid for it?

All those questions will be answered in open court.

Could it be Quintanilla's continued attacks against Joe Barton, the US Congressman who aplogized to BP Petroleum and said screw you to the residents of the Gulf and who is seeking reelection in a District that is over 51% Hispanic and includes Quintanilla's home, any relationship to Jim Barton? HMMMMMMMM

  7. Mr. Quintanilla do you really believe the people of Brownsville are so stupid they cannot look of the term mediation and learn that it means a process whereby parties agree to negotiate a settlement with the assistance of a third party? You won nothing in mediation. By your own admission you were months behind in your mortgage when you reached a mediated settlement. Even a complete idiot understands that means you paid to avoid foreclosure or agreed to have the arrearages tagged on to the end of the note. This means you won nothing.

Mr. Quintanilla with your endless lies you do not help yourself. Why not post your so called winning mediation settlement? You cannot because you never won anything. A mediator cannot award anything or decide a case. All they do is aid the parties in trying to find a settlement.

And to set the record straight over the law three years my mortgage was fold three times. So long as the terms of the mortgage remain the same they do not need my permission. With all of the money you have, why not hire an attorney?

  8. You are avoiding the coincidental nature of the parties involved in the purchase of Quintanilla's mortgage. I believe he refers to the judge already put a stop to the unscrupulous activities by the Mortgage company and granted Quintanilla's motion and then order both sides to mediation. As you will note from Quintanila's Motion he refers to no CLAIMS or arrears claimed by American Home Mortgage. explain the fact that the owners of te new note is a gas exploration company with strong relationship with Joe BARTON. Any relations. How much are you getting paid for this hatchet job.

The terms of he Mortgage did not remain the same and that is why Quintanilla originally sued and WON, you idiot.

  9. Any relationship between Tea Party supported Joe Barton and Jim Barton?

  10. Tea Party leader backs Barton; Republicans, less so

It's pretty darn obvious what Democrats are doing today -- ripping into Rep. Joe Barton (R-Tex.) for his "apology" to BP in a fashion that makes Oceania's campaign against Emmanuel Goldstein look amateurish

Now we all know that Jim barton is a proud member of the Tea Party. Now we know wht all the vicious attacks against Quintanilla, is he running against Barton?

  12. Quintanilla did not have an attorney representing him against Zayas Cortez and his lawyers and he beat the shit out of Zayas. The lawsuit was filed by Zayas and it was Zayas who wanted to dismiss it after Quintanilla file a Motion for Sanctions on Disclosures and Depositions. He did an excellent job better than Zayas the same guy who conducted the deposition by Ms. Rey. I was there and I am a lawyer who was pretty impressd by his arguments against several lawyers.

  13. Mr. Quintanilla the reason Mr. Zayas dropped the lawsuit against you is because Ted Parker was dismissed from the lawsuit and he saw no reason to secure a judgment against somone with with over a half million dollars in debt and judgments. The facts are you never proved any of your claims against Mr. Zayas. Why did you drop your lawsuit?

Your lies are sad. It is as if you do not even know how to tell the truth anymore. By your own admission in the documents you filed in court you failed to pay your mortage from July 2007 through April 2011. By your own admission the mortgage company had to pay $48,527.34 in property taxes for you to avoid having the house foreclosed on by the Dallas County taxing authorities. You have lived in this house since 2007 without paying the mortgage or property taxes. This was as of April 2011. This is not some bogus conspiracy by people named Barton. This is what you agreed to be the facts in a document you yourself signed in April.

Enough with this nonsense. My flight to London was just called.

  14. Zayas dismissed the lawsuit not Quintanilla. So then you will admit that Zayas filed a lawsuit against Ted Parker when he prevailed and was dismissed from the lawsuit he dismissed it against Quintanilla. Seems like Zayas is on a revenge trip can't get over the fact that Luci Longoria kicked his ass. The Jude will hear Quintanilla's Motion and then we will see what happens. Coincidental that the company that owns Quintanlla mortgage is a gas exploration company. Hmmmmmm does not pass the smell test for me. PS You don't even know where London is.

Unfortunately this is what happened with Catalina Presas-Garcia. So sad for her family.

  16. You mean to tell me this 54 year old man has two very young children? and he has a 6000+ square feet home with a paid servant (by whom?) but yet my taxes and yours pay for his children's Medicaid??

    ReplyDelete
  17. Yes. That seems to be the way it works in his world. Remember, this is all the result of white oppression of the Latinos. They are the ones forcing his children to use Medicaid for healthcare. It is all the gringos who will trick you into huge mortgages and a lavish lifestyle only to present you with a bill and try to collect. Even the white run IRS seems to be in on the act. Now just as soon as he can get all the gringos on the school board to stop oppressing the poor Mexican children, everything will be ok. Accion America (with or without the www) will be here to see to it and install a proper hispanic school board and and airline to go with it.

  18. Quintanilla is an activist not a millionaire. He has been in the forefront of fighting for the Latino community effectively and very publicly and he has not asked any of us for a freaking dime.

  19. If it were not for Quintanilla BISD would still have the gang of $4 giving contracts to friends and compadres. We would have had to lay off teachers and staff because they plummeted our fund balance. W would be worse off with a double negative rating from Fitch and we would have the worthless superintendent that left to go to a district the size of a dime. Not to mention that Quintanilla made it possible for companies like Blue Cross Blue Shield to come to Brownsville, No Mas Johnny Cavasos. Ask BISD employees how they like their insurance.

  20. Has anyone noticed that Jim deleted the comment that asks how did this company buy Quintanilla's mortgage and many of the questions being raised by carebrownsville. When you lead and you create change be prepared to be attacked by those that fear us the most. White men like Jim barton who has been silent of Joe Barton. Is he your primo Jim?

  21. To anon at 6 03 Quintanilla pays more taxes in one year than you pay in your lifetime. Jim show us your money who pays you. Tell us a little about Jim Barton. Where do you come from? Where did you work? How are you earning a living? Who pays your mortgage or do you have one? How much are you worth? What have you done in your life?
