City Commission Removes $1.00 Bag Fee, Retains Plastic Bag Ban

From the Editor: The Brownsville City Commission, after meeting in Executive Session, unanimously approved in open session removing the $1.00 bag fee, but preserving the ban on plastic bags in the City of Brownsville.

This action was in response to a ruling last year by Texas Attorney General Ken Paxton that the bag fee constituted an illegal tax on the citizenry.

Former Mayor Pat Ahumada disagrees with this decision and presents an alternative viewpoint in the letter published below:



"There is one word that describes this city administration and commission. The word is PATHETIC! They are not fighters or doers; they react, or wait for things to happen. They are useless.

The mayor and city commission voted unanimously to repeal the bag fee, but will keep the bag ordinance. 

If this makes sense to you, then you are just as stupid as they are. By repealing the bag fee, you in essence repeal the bag ordinance. Welcome back to the third world. 

We should have fought the Attorney General by inviting all other cities with similar interest in a bag ordinance to petition the state legislators to pass legislation that would satisfy the Attorney General to keep the bag ordinance. We should have sought other alternatives before giving up. 

We could have proposed the fees collected go towards what the city pays Waste Management for picking up our trash. On the alternative, we could have amended the ordinance for Waste Management to collect the fee to fund a curb service recycling program with free containers to households. 

I believe both of these scenarios could put Brownsville in compliance with the Attorney Generals interpretation of the law he is applying. 

The fee is the incentive for people to take their own bags when shopping. We can always use the money to improve our environment by reducing waste at our landfill and reduce our cost with Waste Management. 

The solutions are there, but with two lawyers, one doctor, one teacher, one tortillero, one jewler, and one beauty queen on the commission, along with a city attorney and city manager who collectively cannot come up with a solution to this matter, is PATHETIC. 

Even Forest Gump can do better than them. 

Ken Paxton agenda is not the State of Texas or the best interest of the citizens. 

I can relate to him, it is like when a friend of mine and I went to meet with Police Chief Rolando Hernandez two weeks prior to the DA and BPD raiding my sweepstakes store. At said meeting two weeks prior, I asked our chief of police, if sweepstakes was illegal? I also asked him, if I needed to close down voluntarily? Chief Rolando Hernandez response was, “I don’t know”. He went further to state that he would meet with the DA Luis Saenz and get back with me, which with 30 police officers, cameras filming the raid and parading my arrest. All for political gain, when all I offered to shut down voluntarily. 

The DA Luis Saenz had a different interpretation to the same law his predecessors for 15 years said sweepstakes was legal and our local police allowed sweepstakes stores for years to operate with never shutting down any sweepstakes, but politically some people enjoy targeting others when it meets their political agenda as Ken Paxton is doing with the plastic bag law suit. 

The Attorney General’s agenda is the same and does not care about Texas. We should have exposed him by going to trial on this matter. We had everything to gain and Paxton had everything to lose if we prevailed.

  17. First let me say, I am proud of who I am and where I come from. I did not have it easy as an emancipated minor who was forced into adulthood before any child should be. I am proud of being a shrimper because that was the only frontier a child forced into adulthood could get a job with no questions asked. I worked with some of the toughest people you could find, but I made a good living. I find nothing disparaging about the industry that gave me life and allowed me to raise my family. Even though I did not have the many opportunities like going to college, I am proud to be a self taught individual who read a lot while at sea and was always interested in doing better for myself and my family. For those who want to belittle me for not having a formal education, that is your problem because I have proven that I can compete with many educated people on many levels, as compared to some with an education who prove to be idiots. As a former shrimper, I can give those who blast me a lesson on how to make our city better, which my record of accomplishments can attest is far better than what we now have.
    If John Villarreal gets offended for being a Tortillero, that is his problem. The point I was making is that you have all these people from different walks of life who are not able to find a solution to a problem that can be solved, but instead prefer to repeal the bag donation fee without putting up a fight. They preferred the easiest route instead of presenting solutions to keep the bag ordinance is PATHETIC. I cannot understand cowering, because I do not know how to cower in the face of adversity as our commission has done.
    The bag ordinance was never meant to be a ban, but a choice for people to have when shopping. The bag ordinance intent was to use the fees generated to improve our environment and our culture to a higher standard and repealing the fee undermines the goals to build a greener city.

  20. In Austin, the customer that does not have a bag, can be sold a large plastic bag for 25 cents. The store keeps the fee. The issue in Brownsville was not so much the charge, but it was the fact that it was being remitted to the City. There is nothing inappropriate with keeping the bag ban and allowing the stores to charge for the selling of a bag. Some stores provide paper bags free of charge as well, just like was done before the introduction of plastic bags.

    Eddie Trevino legal fees $489,000 x 4 years= $1,956,000
    Mayor Martinez wanted to give away Lincoln Park valued $21,000,000 million
    Mayor Mtz pushed the Casa Nylon property purchase at $2,300,000 and we have no use for it and it has been taken off the tax rolls.
    Mayor Martinez pushed for the Tenaska power plant joint venture very aggressively when he was advised not to by Fitch Bond rating company and financial advisors. This has already cost Brownsville citizens 36% in higher utility rates, thanks to Mayor Mtz. This Tenaska scam is estimated to have already cost Brownsville citizens $40,000,000 million and we have nothing to show for the investment.
    Mark Sossi sexual harassment lawsuit cost taxpayers a lot of money to defend.
    Enormous amounts were spent on the lawsuit against the firemen
    Real estate purchases not needed and purchased at inflated prices costing taxpayers millions is nothing in comparison to what it would cost to fight the AG on this matter.
    Add, the trip to Bogota Columbia that was a vacation for the mayor and company
    Should I go on? Millions squandered by this administration and you are trying to justify not fighting the Attorney General for singling Brownsville out with his self serving agenda. Goes to show how you and those like you can justify doing nothing.
    The bag ordinance, like the area maintenance ordinance I introduced in the 1990’s generates millions to improve the quality of life for Brownsville citizens. Repealing the bag fee will be a negative cash flow to do projects to improve the environment and our community. The ordinance could easily been amended specifically tailoring the ordinance for waste management to collect the fee that could result in lowering garbage rates for Brownsville citizens or to introduce a city wide curb service recycling program free to citizens of Brownsville, saving us millions in landfill and improving our environment.
    The last thing, why not unite with other likeminded cities and collectively pool all legislators to introduce a bill in Austin to cut Paxton’s wings in the interest of the environment and Texas taxpayers who shell out to pick up the bags littering our highways and communities? No, that is too much work for this mayor and commission to even try to do.
    The problem is that this administration is very PATHETIC, full of excuses not to do anything, because it is easier for them to do. They prefer to work hard at scamming us with real estate purchases at inflated prices or squandering our money with projects like United Brownsville.
    The problem is the administration reacts instead of being proactive, which they should have done by hosting public hearings on this matter before taking the action, because they are too stupid to come up with any ideas on their own.

  26. There is no exit cue when you care about your community, but I got to the point not to care about what others think. Being degraded viciously began with the Herald editor Robert Kahn, the elite and special interest and to this day they have tried to criminalize and discredit me.
    I can get along with anyone who wants to work on behalf of our city, but not with the Carlos Marin’s, Atkinson’s and others whose agenda was not the city. My patience has worn out and has lead to contempt for those who seek to rape our city. Being mayor is not a hobby or a part time job, but a full time job. Being a commissioner is not about having a title to promote oneself, but about going to work to make Brownsville better. These elected leaders are not engaged and are a total failure as leaders.
    It is okay not to know about something, but at least seek competent advice before acting and doing tremendous damage as done with the Tenaska and Casa Nylon scams, along with the many other failures and then they shirk it off as nothing.
    Let’s look at the animal chip ordinance, which we pushed very hard to get done, but was blocked by the city manager and Art Rodriguez for years. Now that they passed the ordinance without input from us, which is a good thing, but it is reported to have a $250 fine for not having the chip and a $250 fine per day when the animal is at the shelter. If this true, it is beyond ridiculous to assess these penalties on citizens with the lowest per capita income in the nation. This administration did evict our nonprofit animal clinic at the city shelter and is chipping animals for $5.00 with no vet supervision, which is a risk for the animal. The nonprofit clinic provided no cost care and meds to the city shelter worth thousands of dollars, now they send the animals to the vet in Harlingen because they had not back up plan when they evicted the clinic from the shelter, which proves how smart these people are.
    This administration also undermined the progress we had made on recycling, which I introduced in the 1990’s and this too turned too crap, as you rightfully pointed out. They do not know what they are doing and fail to get guidance to make it better, but they are good at destroying and undermining.
    But, let’s go back to the mayor and commission and degrading, I have been degraded enough by this mayor and members on the commission to last a life time, but I took it. This city manager with the former police chief and Pete Gonzalez tried to frame me and the evidence was shredded that would have proven who took the check, but took it and paid a very high price. So, don’t tell me about being degraded. If they can dish it out, they can take it.
    You want to give them credit, let’s talk about United Brownsville, Tenaska, Casa Nylon, the Lincoln Park give-away proposal, higher utility rate increases, squandering taxpayers monies speculating in real estate and pet projects, evicting the animal clinic from the shelter, undermining the recycling program, secret contracts, and voting to repeal the bag fee without holding public hearings and failure to stand up and fight for Brownsville against an overzealous Attorney General.
    I had nothing to do with the current recycling failure, nor the cigarette butt cans. I was an environmentalist by taking action to protect our environment dating back to the 1990's. I stood with others to block efforts to develop Boca Chica beach, supported to establishing wild life corridors, introduced and funded initiatives to reforest our city and going green plans, advocated for wind energy over fossil, plus being a big advocate for the humane treatment of animals to make Brownsville no kill, which was also undermined by city management and others who would say they cared about animals, but their actions or lack thereof proved otherwise. Forest, I will let you have the last word on this.

  29. If you want to work to build a better city and be a professional by agreeing to disagree, I am here to work with you or anyone who wants to make the city the agenda. If you want to work to build a consensus to make Brownsville a one issue city at the expense of everything else, or if you want to build a consensus to give away Lincoln Park, buy more real estate like the Casa Nylon, undermine the animal shelter, undermine the recycling program, allow management to go unchecked, or if you want to hire incompetent people like Mark Sossi, fund projects and do unchecked cost over runs in the millions like the sports park, or target citizens to subsidize squandering their money with scams like Tenaska, United Brownsville, and other deals that does not benefit the city, then the people you elected are your consensus builders and a great example of your values.

    I am not your kind of consensus builder that is for sure, because I am a fighter for the citizens of Brownsville and made the city the agenda with no hidden interest. This administration has hurt our city more than any other administration I know of. They are not engaged or really care about our city.

    I did build a consensus to cure a $2.0 million deficit, do capital improvements, cut waste, lowered utility rates, held developers accountable, and introduced many initiatives to improve the quality of life for Brownsville that is on record.
    You prefer to harp on what ails you, which is that I am not corrupt like your buddies. You obviously prefer and thrive on corruption, which is why you criticize and try to bring me down to make yourself look and feel better, but I am beyond reproach. Not one friend or family got a job through me. I never went into making deal with others like this mayor did with the Casa Nylon swindle and what I suspect with the Tenaska deal and hiring Eddie Trevino as BPUB Board council which has cost us millions.
    In comparison to these part time elected leaders who are not engaged, I was a full time mayor, with an open door policy 24/7 and was engaged. It was a job and I did my job... to make things better for Brownsville. The results are in the proposals and actions taken whether it was to restore passenger airline service to our airport when we had none or to reduce the penalty fee at PUB for those who do not pay on time, which is how you make things happen by introducing these type of initiatives that changes Brownsville for the better.

    So, if you are a professional and want to make Brownsville the agenda, I am here to work with you and I will defend tooth and nail anything you propose that is good for Brownsville.

It is sad, but based on the Herald's bias reporting, the bloggers like McHale and Montoya who are not responsible bloggers and thrive on fake news or creating false perceptions, you will soon elect people like Erasmo Castro, William Garza, and others who have nothing to offer, because this is the best Brownsville can produce as leaders. I am not perfect, but my biggest sin was standing up for Brownsville and thrive destroying those who will stand up for Brownsville. Are you against the things I did to make Brownsville better. cleaner, safer and reducing your tax rate and utility rates with initiatives that made it possible? It is a rhetorical questions, because obviously you prefer this administration who has all but destroyed Brownsville with their scams, which is going to lead to higher taxes and more utility rate hikes.

    People do read what I post and in spite of what you say, I get positive feedback and some even thank. As far as bad leadership, it is not a crime to elect someone like Tony Martinez who pushes to buy real estate at inflated prices. You are the one responsible for electing these people, so if you want to complain, then complain all you want. I am pointing out their failure to defend Brownsville against Paxton, or to at least host public meetings before voting to repeal the bag fee.

    You do not have to agree, but there are plenty of people who do. And, others wonder how they make decisions without an thought process, after all they voted to repeal without introducing a plan to make it better. I guess that is your kind of reasoning logic is satisfactory, but for us who want a cleaner and better environment, we expect more from our mayor and commission.

    I am not law enforcement, nor the one responsible to investigate what they do or do not do, but I am a citizen who has the right to question, support, or oppose when our elected leaders fail to stand up for Brownsville.

  44. This post started with the bag ban but quickly deteriorated into oersonal attacks about people that have nothing to do with the ban. What this demonstrates to me is that anything Mr Ahumada posts becomes a polarizing issue. That in itself demonstrates the mentality of people reading and posting commentary. To say paranoia without you knowing how I know is just an assumption of yours, which you are definitely entitled to. Truth has a way of coming out..

  47. Jim, can you please find out why the city of brownsville is still collecting the bag tax? The managers at heb and Walmart have told me that they are waiting on direction from the city as to end. My calls to city hall have remained un returned. Is the attorney generals office aware of this.? Thank you Jim for staying on this.

  49. The plea agreement approving to repeal the bag donation fee approved by the city commission does not take effect until the AG agrees and both parties sign the agreement. Then once both parties agree, the suit against Brownsville is dropped and the bag fee donation is repealed, but until then the fee continues to be collected. Then you can save what you use to donate for bags to pay for cleaning up the litter when you pay taxes, which will not be enough and those who were against the bag ordinance will be complaining how dirty our city is and the environment is hurt by the bag litter.
