Death row inmate John Allen Rubio, who murdered his three young children in 2003, decapitating them, has been denied the ability to appeal his conviction by the Fifth Circuit Court of Appeals.

Rubio, a prostitute and paint sniffer, who resided in the 800 block of East Tyler Street, executed his 14 month old boy, 2 month and three year old girls, claiming they were possessed by evil spirits, then had sex with his common-law wife, Angela Camacho, who is serving a life sentence for murder.

District Attorney Luis V. Saenz has called for Rubio's execution.
