On His Way Out the Door, City Manager Charlie Cabler Sued by Unretained Municipal Judge

Assuring that just-resigned City Manager Charlie Cabler will not go into retirement without vexation, former Associate Municipal Judge John Williamson has filed a civil rights complaint in United States District Court, Southern District of Texas, Brownsville Division, against Cabler and Municipal Judge Bobby Lerma and the City of Brownsville.

Williamson, represented by Brownsville Attorney Ed Stapleton, asserts that his civil rights and free speech were violated, when he acted as a whistleblower, exposing Municipal Court practices that violate law.

Williamson served as an Associate Municipal Judge from September 24, 1999, being reappointed every two years, until the expiration of his last term October 7, 2017, at which time his contract was not renewed.

Williamson claims he was "terminated" for exercising his right of free speech concerning "numerous legal deficiencies" in municipal court operations.

According to Williamson, then Presiding Judge Ben Neece had no system by which the court produced formal sworn complaints for traffic court defendants who failed to appear by their appearance date.  He contends that without a complaint, any arrest warrant is invalid, which then exposes the court, city, jail and arresting officer to being charged with "illegal activities" and civil rights violations.

Williamson also cites Texas Criminal Code that he claims support his contention that failure to file a complaint within two years of a traffic violation means a valid sworn complaint and warrant can no longer be issued.

Williamson claims he was summoned to a meeting with Charlie Cabler and Municipal Judge Bobby Lerma and "others" to discuss his speaking out for proper procedures.  At that meeting, Williamson says he was threatened with not having his contract renewed and then assigned to the least desirable court schedule.

Williamson also accuses municipal court of "masking" moving violations of truck drivers commercial driver's licences, getting cases dismissed after making a contribution to the Brownsville Police Officers Association.  Williamson further claims these monies were handled by Lerma's secretary, Maria Gamboa, and that the process was not audited.

  1. If he can prove his claims this means Lerma was in on the corruption from day one. It also then would support he was in on the corruption with Saenz as to the game played with Cesar de Leon. It will be sad if this becomes fact because Lerma chose to allign with Neece. Pay attention Cesar, first you now Lerma to keep Neeces corruption of the MC going. Neece is going to dump you Cesar.

    Let the chickens come home to roost. For all his fool audits, for all his persecution of the fire chief and others, Neece's construct begins falling apart today. Suddenly it becomes clear why the Police are producing statements supporting Neece's version of events in his ridiculous 'audit committee'. This whole affair has been an exercise in terrible political theater. DeLeon, that putz, will soon cut bait and run tail tucked between his legs to his gilded hole where he can gaze upon his effete face forever in a mirror, one of Sartre's rejected characters. Mayor Plutocracy-Martinez will soon know the pain of handing power to the ambitious Brutus, when Brutus turns his daggers on him over whatever is most convenient. Meanwhile, THE CITY STILL HAS ONLY 7 AMBULANCES. GET YOUR SHIT TOGETHER, IDIOTS ! THE VISIGOTHS ARE COMING, AND ROME MUST NOT FALL !
