Couy Griffin of Cowboys for Trump at January 6 Insurrection |
For those curious as to whether or not Donald Trump should be disqualified from seeking the presidency or any public office, we submit Section 3 of the Fourteenth Amendment to the Constitution:
Fourteenth Amendment Equal Protection and Other Rights
Section 3 Disqualification from Holding Office
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
A New Mexico judge ordered the co-founder of Cowboys for Trump removed from public office last year over his presence at the U.S. Capitol during the Jan. 6 riot.
State District Judge Francis Mathew removed Otero County Commissioner Couy Griffin from his elected position "effective immediately" and banned him from seeking further public office, citing the 14th Amendment's clause barring those who have taken oaths to uphold the Constitution from holding federal or state office if they have engaged “in insurrection or rebellion."
“Due to his disqualification under Section Three of the Fourteenth Amendment, defendant is constitutionally ineligible and barred for life from serving as a ‘Senator or Representative in Congress, or elector of President and Vice-President,' or from ‘holding any office, civil or military, under the United States, or under any State,’ including his current office as an Otero County Commissioner,” Mathew wrote.
If this Amendment to the Constitution applies to one of Trump's henchmen, Couy Griffin of Cowboys for Trump for his role in inciting the January 6 insurrection, how much more so should it apply to Donald Trump who did exactly the same thing? After all, Griffin was not found to have committed any actual violence January 6. His role was simply that of encouraging, promoting, inciting such violence, just as Trump obviously did.
Lock Him Up.
