Attorney General Greg Abbott's Letter to District Attorney Luis Saenz Regarding Issuance of 72 Hour Marriage Waiver by Justices of the Peace

From the editor:  Please note that the Attorney General rules that a Justice of the Peace is not "a judge of a court with jurisdiction in family law cases," and "thus may not grant a waiver of the 72 hour waiting period after the issuance of a marriage license."

Abbott said it would further be unnecessary to rule on a JP charging fees since a JP is not authorize to grant the waiver in the first place.

  1. Does this letter from the AG force the Cameron County DA to take action, or does it mean Luis Saenz can continue to "plea" bargain with with Hernandez Klan? The AG letter would seem to indicate wrong doing by Erin as a Justice of the Peace.....but will Luis Saenz protect the citizens or will he protect his political ass by ignoring this violation by Erin Hernandez? Or has Luis already "plea bargained" this as a part of the Ernie Hernandez "slap on the wrist with a wet noodle" to get another Democratic corruptor out of having to face a jury. Luis Saenz continues to be part of the problem......and has taken no steps to limit political corruption in Cameron County.

    1. Again, I will state the problem is that she was not the only JP doing them. If Luis Saenz goes after her, he better go after all of them. As a former county employee, I can tell you this has been going on for years. She is being used as a scapegoat for a situation that is much bigger.

  5. 12:12pm is Erin Hernandez, you won't get away easy like your father did. Justice for Brownsville and Cameron County put Erin Hernandez and all the corrupted Hernandez in jail, where they belong.

  6. It has to be Erin saying thatt all the JPs have been doing it, i know for a fact that NO JPs do it, is very clear in the JPs manual that you are not suppose to do it, she did it because she thought she could get away with it, like her parents have been getting away with thigns forever

  9. I think your wrong there Jim and your statement has no merits and pure speculation as to what action(s) the District Attorney will take. The AG letter was just received. You cant expect the DA to impanel a grand jury over night. There is a process that must be followed.

      You have serious reading comprehension difficulties. Where did I say the District Attorney would or should initiate a grand jury? I simply reported the Attorney General's findings. Damn, folks are slow!

    2. R.Rivas, nearly six months have passed since the AG letter was penned and I do believe it is your statement that has no merit. The DA's office has been in front of the GJ countless times in the past six months and nothing has been done to JP Hernandez. DA's like Saenz are exactly what's wrong with this county and the RGV, in general. Nothing short of criminal when the top law enforcement official in a county refuses to prosecute those who operate contrary to the law. If Saenz refuses to enforce laws he was elected to enforce, there's no need for him collecting a salary he has not earned.
