Emil Bove, a former attorney for Donald Trump, is close to being confirmed for a lifetime position on the Third Circuit Court of Appeals, a powerful court that handles cases involving civil rights, voting laws, and immigration. His nomination has sparked alarm, not because of his qualifications, but due to concerns over his loyalty to Trump and controversial record.
More than 75 former federal and state judges have urged the Senate Judiciary Committee to reject Bove’s nomination. In a letter, they accused him of abusing power, mistreating law enforcement, and disregarding the law during his recent role at the Justice Department. Among the signatories is J. Michael Luttig, a respected conservative judge appointed by President George H.W. Bush and now a critic of Trump.
The letter cites multiple controversies from Bove’s six-month stint in a top DOJ role. These include dropping federal corruption charges against New York City Mayor Eric Adams, allegedly to gain support for Trump’s immigration plans, and targeting FBI and DOJ officials involved in January 6 investigations. Over ten DOJ lawyers reportedly resigned in protest.
A whistleblower, former DOJ attorney Erez Reuveni, claims Bove encouraged illegal actions to push harsh deportation policies. Reuveni offered to testify before the Senate, accusing Bove of urging staff to ignore court orders and make vulgar comments about judges. Another DOJ lawyer was allegedly fired for refusing to lie in court and exposing Bove’s conduct.
Critics say Bove punished investigators who didn’t follow political orders and pushed extreme immigration tactics under outdated wartime laws. Public defenders and judges have also flagged his aggressive courtroom behavior and lack of respect for defendants' rights.
Despite these serious concerns, Bove could soon secure a powerful judicial post. If confirmed, his rulings could shape civil rights, corporate regulation, and constitutional law for decades.
Bove has refused to say whether President Biden fairly won the 2020 election or if Trump can run for a third term. He also hasn’t denounced the January 6 Capitol attack and claimed he doesn’t remember where he was that day, even though he advised Trump on pardons for those involved.
At his confirmation hearing, Bove denied wrongdoing and said, “I’m not anybody’s henchman. I’m a lawyer from a small town.” But many believe his nomination reflects political loyalty over integrity. The Senate is expected to vote on his confirmation soon.
