Names Surfacing for City Election to Replace Cesar de Leon

"The city charter calls for an election within 120 days of the resignation, disqualification or death of a city commissioner," so stated a local civic expert.

(Just, a word on the rationale for Cesar's resignation:  It was a clear conflict of interest for him to work in Municipal Court, his favorite venue.  Many of those cases require deposing law enforcement.  Technically, anyone in the Brownsville Police Department worked under the City Commission, including Cesar de Leon.)

If Cesar de Leon's replacement were left up to the city commission, local attorney Nurith Galonsky might be a heavy favorite.  She's on the P.U.B Board of Directors, but also the daughter of Abraham Galonsky, a close friend of Mayor Martinez and Commissioner Neece.

Mr. Galonsky famously sold one of his downtown buildings, La Casa del Nylon, to the city for $2.3 million, roughly triple its value.  The deal was unethically "negotiated" by by Mayor Martinez law partner, Horacio Barerra in 2012.  The city had no actual need for the building and it's been deteriorating for 5 years, off the tax rolls.

Another name being floated is that of former mayoral candidate Erasmo Castro, who shared a reasoned public comment at October 3, 2017 City Commission meeting, calling for Cesar de Leon to resign.

  1. Lol Erasmo Castro, would be the perfect water boy for Mayor Martinez, as soon as he seats at the commission, he will show his real color, just another greedy rat, starving for a little power.

  2. Jim you are buying into a bogus argument on the conflict. many city commissioners have crossed examined BPD officers on the stand. There is nothing there. The was a forced problem on Cesar. He either played along or is too stupid to see how they backed door him with a corrupt deal. Hows does a Judge whose budget is in part governed by the city commission remove a city commissioner from a case, when this problem has presented itself over and over again? De Coss should have recused himself. Every lawyer I have spoken with agrees De Coss is either incredibly stupid or was part of a corrupt back door to force Cesar to resign. This has gotten real interesting. Why does Ben Neece get to cross examine BPD officers in his DWI cases and that is not a conflict? Why has Saenz not filed a motion to recuse Ben Neece in all of his criminal cases involving the BPD?

    Every lawyer to a person who has discussed this with me wants me to take down De Coss in hopes to save himself he will tell law enforcement the truth. This only got so so much more interesting. Disqualifying an attorney is nearly impossible. De Coss ignored the law for political gain and he will pay for it with his political career.

    2. I personally just think they used the stunt to spook him knowing he is struggling financially, and then someone convinced him he should move on. "In Texas state court, a party who files a motion to disqualify opposing counsel typically must prove actual prejudice before a court will grant the motion. See, Meador, 968 S.W.2d at 350; Ayres, 790 S.W.2d at 558; In re Bahn, 13 S.W.3d 865, 873 (Tex. App.—Fort Worth 2000, orig. proceeding)" What was the actual prejudice? Cesar does not represent the city or the police department. If his representation in a criminal case means possibly the city being sued, there is no conflict. He is just not allowed into the executive sessions during discussions. Jim this happens all over the state. Either Cesar was promised something, or he was spooked and played along. He really needs to take de Coss to the Commission on judicial conduct, and his order on mandamus. I am working on a disqualification which is black and white as to conflict of interest. It is not easy. Cesar was played or promised something to resign. There is no criminal conduct here, or even a basis for disciplinary sanctions. This story has gone from interesting to nuclear. It could be as simple as Saenz telling Cesar he better accept the order or further investigation will be done by Saenz's office. God knows there is enough on the tape. If such a suggestion was made, Cesar can take Saenz to the State Bar. No Jim Cesar was spooked with a con, or a threat of criminal investigation which has nothing to do with the case in MC.

  3. Actually, I did bring up Neece because I thought he still practiced at Municipal Court, but, I guess I was repeating the party line.

    1. Jim, Neece has active cases in county court wherein he is cross examining BPD officers to defend his clients. What is the difference? If a MC Judge can remove city commissioners from cases it sends a strong message to all city commissioners that judicial abuse will be used to try and influence the MC budget. This merits a major investigation of De Coss. And sadly although I like Bobby Lerma a lot and think he was a great choice for Chief Judge, he will sit on the side lines until it is too late to protect the court and his long family good name.
