Downtown Live Music Event Shut Down by Assistant Fire Marshall Based on Anonymous Complaint

Leftover Crack, a punk rock band from the New York borough of Manhattan was prevented from performing in downtown Brownsville Tuesday night by Assistant Fire Marshal Raymond Harris.  

"I could tell by the man's body language as he charged up the sidewalk that he was intent on shutting us down," observed a patron.  "He was obviously angry and annoyed."


Quickly, seven police cars lined up in front of the art gallery, music venue known as BAM, Brownsville Artists and Musicians, at 1045 E. Washington St. in downtown Brownsville.  

"We're not the one's shutting you down," stated the police commander.  "He's the one shutting you down," he said, pointing to Assistant Fire Marshal Raymond Harris.

"An anonymous tip that we were over capacity led to a sweep and inspection that resulted in recommendation to reapply as bar/nightclub. Of course, we will preserve our arts theme. It makes no difference that other galleries have live music at their place because nobody has tattled on them. We feel like the metaphorical freak in the principals office," stated the gallery manager.

When asked if the marshal had actually done a head count, the manager responded:  "He said we had changed layouts from their records and that we weren't supposed to be using the back courtyard or storage area unless we have it inspected and subsequently fixed. The headcount was reasonable but heavy on the bands who were there. Ultimately it's an issue of changed floor plans and that we were playing live music, which meant we were disqualified from old inspections."

The event was stopped at 11:30 PM, four hours into the program and just before the headliner, Leftover Crack, took the stage. The punk rock group on their 2015-16 U.S. Tour had played at Detroit, Chicago, Minneapolis, Memphis, Houston, Austin before Brownsville with El Paso, Mesa, AZ, San Francisco and Los Angeles dates ahead.

While the patrons walked away to their cars, one angry ticket buyer shouted:  "This wouldn't have happened if they'd been playing Mexican music.  Damn, these bicycle events shut down the whole downtown and no one complains.  Someone doesn't like our music."

We did reach out to the Brownsville Fire Department for an explanation.  Fire Marshal Danny Villarreal will not be in the office until Monday, an operator said. Assistant Fire Marshal Harris was out of office in the morning, then in an afternoon meeting.  When we called later in the afternoon, he'd already gone home.  

Secretary Cindy said:  "I told you he(Harris) would be in a meeting. What did you want to know about?"

When told that I wanted to know why the music event was shut down last night, she said:  "That's what the meeting this afternoon was about."

  5. it's funny that the city is spending millions on downtown development but shuts BAM down /.. because BAM is the type of thing that happens in good downtowns ...

    2. It is not a sombrero fest! It is a drunken community party. Even the so called sombrero committee members are totally DRUNK every night of the event. Do not believe it? Just go to sombrero fest all organizer can be seen walking around with a beer in their hands.

    3. BAM has soul. It is an open-minded community in a sea of status quo shallow and cliche traditions that don't speak to the many people that go and support BAM and BAM stands for which as I understand it is creativity and freedom of expression...in the arts, speech, etc. Viva BAM.

  6. Shut down the Sombrero Fest too! It's too loud, over capacity, and causes traffic jams! It's a nuisance for us people that really live in downtown. BAM! You guys are OK in my my book.

  9. You should sue the fire department and name this assistant chief and Sue as unnamed the rest of the responsible parties. They thought that the cartels would give them thousands to occupy downtown, but they are all on the island. This is what they do when locals do stuff.....

  10. Sue the fire department, the assistant fire chief, and the city manager...and any unnamed parties who were involved. They expected a bunch of cartel money, but they are all buying up the island. This is what they do to locals when they bring good business to the fledgling downtown district.

  13. It was a snitch that ruined it for everyone. Mr. Harris is trying to help, despite the issue. They all are. This story was nice, but lots of stuff was paraphrased and the context became now exciting than your standard bureaucratic mumbojumbo. As it stands, we aren't allowed to do anything by play a radio at BAM for the meantime. We got a lot of work to do.

  18. You can get mad about this but he was just doing his job, whether it was a snitch or not. If you want punk music to fly in Brownsville you have to play by the rules and when capacity is reached you need a sold out sign. End of story. If Chapas hadn't of been available that night you would've disrespected the guests in the venue and the performers. It's called being an adult and taking precautions. I've been to many punk shows in Brownsville - from Chapas, to Galeria 409, to The Rising Sun and even the school gym battle of the bands. The difference is that responsible adults are conducting these shows that didn't get shut down as opposed to people just wanting to fit in on image and relive the experiences of generations past. You want to expand the music and art scene in Brownsville? Do it right and we can keep on doing this without the authority figures keeping a sideways glance at us. Money and popularity aren't the goals. This is the real world and there are rules to play by.

      BAM "has" followed every rule and regulation "issued" per the City of Brownsville. They can't help it if "The City" changes the rules as they go. Will my opinion get me arrested tomorrow, next week, next month? - - -

    2. You have no clue, only your petty 2 cents and projected inferiority. We work endlessly. We are the ones that put ourselves out there, and it's not for the things you think.

      I'm not going to try and tell you that we are better at adulting. I don't have to prove anything to you. Shit happens. We didn't make a big deal about it. Everyone else did. We took the responsibility and people stuck their necks out for us to keep us there because they know that our efforts aren't selfish. Even the authorities didn't fine us.The cops were nice even! They guided us through the system. I don't care whether you think I'm a movie star or a piece of shit. I do me and I know that someone appreciates the effort to make this little town of brown more than the skid mark of Texas' underpants. What about you? Tell me more about all your wonderful efforts to change this place with your projected inferiority. Oh. Hmm. Anonymity has given you balls and a pulpit. Congrats.
