Mean Mister Brownsville posted a copy of a letter indicating there had been an effort to disqualify Jessica Puente Bradford as a candidate for Congress, District 34. That letter was addressed to an attorney with some association with Adela Garza, Are Martinez de Vara. Mr. Martinez de Vara has now sent me this email with further clarification, indicating his belief that a challenge to Ms. Puente Bradford's candidacy is still possible.
A friend of mine forwarded your Blog post in which your posted the RPT
response to my letter regarding Ms. Bradshaw. I wanted to send you my
letter to the RPT so that you can post for your readers.
The response
from RPT was not that my concerns have no merit, but that due to the
redistricting lawsuit the time under which the RPT Chair has authority
to act was shortened and such time had passed before they received my
letter. However, a Court of Appeals could act to disqualify at this
time.
Though Mrs. Garza and Mr. Hering have chosen not to pursue
this option in court, a Democratic opponent surely could. Ms.
Bradshaw's petition is riddled with errors and omissions, but the
greatest flaw is that she failed to use her legal name on the
application which potentially disqualifies her as a candidate if
challenged in court. Use of legal name is required under Texas Law
and space for nickname is clearly provided on the application. Note,
that the version I am sending you redacts some information from the
original to protect the privacy of the persons being discussed.

Mr. Martinez de Vara also enclosed a 4 page letter, dated April 30, 2012, he wrote to Steve Munisteri, State Chairman of the Republican Party of Texas in which he challenges the eligibility of Jessica Puente Bradshaw as a candidate for U.S. Congress, District 34 of Texas.
He states that Ms. Bradshaw was required to present 500 valid signatures. He claims Ms. Bradshaw submitted 567 signatures but without the required information. He claims 529 signatures omit the district number. He states that 10 signatures are invalid because they omit county information. He states that 52 signatures are invalid because they omit the date. He finds even the notary certification in undated. He found 1 "signature" that lacked a signature. He wants 5 signatures disqualified because they live outside the district. 12 with no address. 2 because only one name is used.
He also claims Jessica's legal name is Jessica Robinson.
Further, under a differnt part of the election code: He wants 13 signatures disqualified because they lack Voter ID numbers and dates of birth.
On the basis of all of the above Arturo I. Martinez de Vara wants Ms. Bradford declared ineligible.
This is pretty frightening! If Ms. Bradshaw is the GOP nominee should could be disqualified in November if the Dems decide to pursue this in court, which they likely will since it'd provide an easy win. Mr. Barton has posted information on the discrepancy with Ms. Bradshaw's last names, which was informative, but she still had to file her candidacy in a certain way. If she truly did file in a way that could lead to disqualification, then Lord help us if she is the nominee.

DeleteCandidate eligibility is a serious matter. Look who we got in the White House by not questioning his qualifications. Using a false name is just dumb. No one would have cared if she would have just put her legal name, and then campaigned using her nickname. It happens all the time. What is trying to hide? Now, even if she wins, the Dems can just bump her off the ballot. Do we really want someone who is this naive and inexperienced representing us in Congress?

What democrat is she working for? My guess is she is a plant by the democrats. If a REAL democrat wins and beats Adela - Democrats win. If a REAL democrat loses but adela wins -- Democrats win. Jesus help us! She is about as much of a republican as vela is a democrat. They must be in bed together. Oops, that might actually be insulting to Vela.
Anonymous, the name issue is not an issue. the GOP asks for legal name but name filing under on a separate box. Candidates on the petition forms are required to put their "filing under" name - not the legal name. This lawyer was hired to create any excuse to get a candidate/s of the ballot for an adela slam dunk. PROVEN HONESTY? LOL! thats a GOOD ONE!

From a candidates viewpoint: When a person that owns a business wishes to donate their services as an IN KIND donation to help a candidate, it is extremely hard to say no. From a South Texan that has been political all of my life my viewpoint: It is probably not the best form of transportation to have used. Having stated both sides, I will say this, any time a person wants to donate something that is LEGAL and HELPFUL to a campaign especially in today's economy it is political suicide to say no to...I have to ask this question, would it have been better if a farmer or rancher had donated an in kind Horse or Cattle trailer to provide transportation to the polling places in? I think we can all agree that NO is the answer to that one... so I say, it is 2012, people are offering more IN KIND contributions and each contribution of any kind is appreciated by any and all candidates.... the rule is IT MUST BE LEGAL and it MUST BE REPORTED on the candidates Finance Reports. . The man that owned the Limo had donated the limo as an IN KIND contribution and I know he meant it to be a positive helpful donation. Understanding the spirit in which the donation was made is what is important.
DeleteI wonder if the reaction would have been the same if another candidate had accepted such an in kind donation for the similar purpose of getting more young people to vote. This is an especially interesting question considering that the other GOP candidates haven't raised as much donations as Adela Garza.
DeleteIts easy to criticize an opposing campaign for doing something, but its insincere to do so when that campaign knows they would love such a donation to help get voters, especially young ones, to the polls. Txs Hmnbrd put it best, its tough economically right now and any donation that is legal and reported is surely much appreciated by any candidate!
Plus, just speaking for myself but I'd love to be driven to the polls in a limo...how cool must that be, particularly for young/first-time voters!

She was in a limo that was donated to her only so she could encourage young people to vote... And I think judging from my view it was successful she had about 25 young voters out with her... We need young people to vote
